 OH LORD ! What could take me away from my weekly responsibility to keep my 148,459 supporters and voters informed? Only one person in the world ... my 97 year old dad, Jack Kleban. A true miracle has occurred in my life ...... my dad's memory, health, and thinking is back to very good indeed ! My ever so gently suggestion struck a cause and effect for him to throw the pills his last wife was feeding him daily down the toilet. And then the wonderful news came in January of 2009 when my Dad requested that I look for information on a retirement residence called The Classic Residences of Hyatt of Pompano Beach It was love at first sight for him and the price was a perfect fit for his budget! And would you believe his last wife refused to move with him, so she deserted my father to return to Pittsburgh permanently. Their divorce will be final next month!
My dad discovered by going to his Bank with me that the four accounts that should have been only in his name or in his trust were also in the name of his last wife. After the wonderful manager read the prenuptial of 1987, the living trust of my mother and father 1986, the durable power of Attorney 2005 for me to act as my Dad's Attorney in fact, which was again signed on each page by my father and notarized by the bank manager that day!, we managed to save about $100,000 from the $400,000 that has been misappropriated (embezzled from my father assets and income)
My dad now lives in a newly furnished and beautifully decorated one bedroom apartment, which is a full 2 minutes from my house. He actually can see if my husband and I are at home from his most comfortable chair in his living room. The food at the Hyatt Residences of Pompano Beach Florida is excellent, the staff are like family, and the other residents are charming and ageless. My father is off all drugs and his health and blood pressure are stabilized and very good at any age. We are now blessed with the love and respect which should be part of every family. First of all I thank God for answering my prayers. I thank my husband Ed, who truly loves my father and who has stood by me over these 4 years of family hell.

Thank you for all of you that voted and supported our campaign. The campaign for Courthouse administrative reforms will continue in 2009. Bev Kennedy won the exposure of "Facts From Fiction" campaign by receiving over 148,459 votes with a "0" budget, yet lost the election to be the new Clerk of Court of Broward County 2008! Her web page was wonderful, thanks to the wonderful talents of Amphion Communications. She is extremely thankful for the hundreds that volunteered, and the thousands that supported her efforts and voted for her. She also gives special thanks: to the Woman's League of Voters that sponsored the very informative TV debate opportunity on Beacon TV Station, Channel 6, NBC, The Urban League. The Sun Sentinel web page exposure to compare the answers of the candidates was a good improvement. Veteran Journalist, Jordana exposed the most startling evidence of misdeed by the Clerk of Courts Howard Forman, in Broward's Daily Review On that other hand, the worst of journalistic efforts: The Miami Herald -coverage and editorial content was lacking in both truth, fairness, and exposure- (Bev canceled her subscription); The Board of Realtors, AFL-CIO, Unions who did not interview or send a questionnaire, yet endorsed Forman without knowledge of facts or fairness, and even the editorial page of the Sun Sentinel deserves some criticism.

THE FACTS: About the Broward Clerk of Courts Office
Federally mandated employment standards must be instituted again; this includes raising the salaries of employees that are at least $10,000/yr too low, and upgrading training and education of the Clerk of Court's staff to bring up the morale. This can be done without raising fees or using taxpayer dollars. The problems of the Clerk's office includes :Federal employment laws are blatantly broken by the Deputy Clerk's Iris Siple's instructions. All job security has been taken away, by illegally mandating all employees are "AT WILL EMPLOYEES",
Bev Kennedy's mission to make the Clerk of Court's services more user-friendly and accessible for the public, the disabled and seniors; offering additional services and more updated information by educating our residents and visitors to the latest information on applicable law changes and consumer help to settle disputes will be postponed until Howard Forman is gone. Beverly states "I am still very committed to the oversight and accountability of the Clerk of Court's 17th Circuit District budget, including to the public disclosure of all monies received and distributed, and monies earned in interest- bearing accounts."
There is still much to be done! The incumbent, Howard Forman's lack of managerial expertise puts Broward County last in the ratings of all Courthouse Operations of the State of Florida! Forman's greatest claim of improvements for residents is now they can pay fines, get married and apply for a marriage license at the Used Car Bldg. of RICK CASE HONDA off of State Road 75.
Yet there still is lack of electronic filing and internet conveniences for all County, Circuit Court, and traffic Divisions which proves costly in dollars, gas and time for the public and lawyers. Already Palm Beach and Dade law firms are turning down Broward County residents as clients because of the negative reputation of Broward County Courthouse increased costs and hassle. The cost of filing fees and the high cost of copying current information online still must be lowered and in some cases abolished.
Bev Kennedy, an independent democratic advocate offered her planning and business experience of 33 years in contrast to the incumbent that ran a campaign with his only claim that he was a Democrat and a 34 year experienced Democrat Politician. Kennedy's education, nationally known ingenuity and applied knowledge of financial & strategic planning for the Clerk of Courts' office facilities and organization would be the best way to describe what she offers in contrast to the incumbent. Howard Forman's lack of management decisions and bad judgment was evident in paying out $787,000 of "bonuses" to over 800 of his employees, (who worked more than 6 months) during the early voting period of this election. This alone can remove him from office! Most importantly Bev Kennedy's research uncovered the Broward County Clerk of Court's undisclosed budget of at least $ 44 million dollars/year, with unspent $ 10 million dollars over the last three years returned to the Tallahassee public Corporation (FLCCOC), (Howard Forman is Chairman of their Council). We have verified for at least three years, $350 million dollars a year (over $1 Billion dollars) collected by the Broward Clerks office, was without oversight or public disclosure... We must bring in a forensic Auditing & CPA firm to set up proper oversight systems as soon as possible and fire Iris Siple, Deputy Clerk of Court, and get Howard Forman to retire.

Your vote for MY ELECTION AS YOUR NEW Clerk of the Courts of Broward County Nov. 4th will start the democratic reforms to assure equal justice for all and financial oversight & accountability for our County!
Before, the incumbent, Howard Forman, as a Constitutional officer abused and abrogated his authority we were rated amongst the best in the State for customer service, accountability and communications... now we are in last place.... 67h!
On July 1st of 2008, Howard Forman, Clerk doubled our court filing fees without public notice.. He's responsible for cutting salaries for many of his employees and promoting & overpaying a few of his very good friends and their relatives without merit, education or expertise. Forman is also responsible for eliminating job security and cutting services to lawyers and raising court and filing fees by more than 100% in most cases. The Last three years, Forman is the only Clerk of Court in the State that did not disclose his $ 44 million dollar budget a year or the more than $350 million dollars that is collected by his office yearly. That is over $1 billion dollars which has not been audited or made public! Yet, I have verified he has returned at least 10 million dollars of our money to a public Corporation in Tallahassee, of which he now chairman!
In contrast my professional experience as a Executive Director and President of a publicly supported Broward County tax exempt organization received the highest "A" rating for management fiscal responsibility and financial reporting. The last 26 years as an award winning financial advisor specializing in governmental employee benefits and Strategic Planning for prepares me to reform the many problems of the incumbent Howard Forman's administration. Also, my firm's consulting experience with 2 former Clerks of Court to strategically plan to improve the technology, communication systems and internet services of the Clerk's Office gives me a very qualified advantage over the incumbent Howard Forman. I, Bev Kennedy as a former Arbitrator with a special certification in Employee disputes, prepares me with a valuable managerial and legal expertise to correct the many legal mistakes.

Our goals are to reform modernize and make positive changes for the improvement of working conditions. salaries, training and employee rights for the Clerk of Court's staff to bring up the morale, thus improve service. The incumbent, Howard Forman has not improved antiquated ineffective technology and information systems that put Broward County dead last in the ratings of all Courthouses of the State of Florida ! Palm Beach County Clerk's office just received the recognition of best in the State of Florida. Why isn't Broward amongst the best? For 28 years before Howard Forman, we were rated 2nd best in the State! I pledge to change this! The lack of services and current information offered online and in the lobbies of all the Broward Courthouses must be improved as soon as possible.
To advance and greatly improve the Clerk of Court's office, I offer my award winning planning and business experience of 31 years, that helped implement the Tri- Rail Commuter Railroad, Water Taxi & Bus."Beautification Broward" , Broward Day Tallahassee , the Tourist Tax and leaving more than $30 million dollars a year in Broward County' Government budgets to fund yearly raises for government employees instead of overfunding the State Retirement Fund.

Immediately upon taking office Jan. 2009, I plan on the retraining of the 900 employees and staff on the newest and best internal and public communications technology systems. There is also a dire need to redo the employee benefits and employee regulations immediately because the incumbent Deputy Clerk & Clerk decisions are out of compliance of Federal Labor law. Even worse, the regulations are unfair, break some Federal laws and are demoralizing to the employees of the Clerk's office. There is much to be improved!

Incumbent Howard Forman is the only Clerk of Court that does not disclose his budget to his County! This is more than careless! His deputy Clerk, Iris Siple does not have the education, training or background experience to administrate professionally, but has assumed unchecked power. This must change as soon as possible! A forensic audit will be done when I take office !
